ACCEPTANCE OF TERMS

By accessing or using FynePDF ("we," "our," "us," or the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and FynePDF regarding your use of our online PDF toolkit services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.

DESCRIPTION OF SERVICE

FynePDF provides a comprehensive online PDF toolkit that enables users to compress, convert, merge, split, edit, sign, and perform various other operations on PDF documents ("Tools"). Our service allows you to manipulate PDF files securely through your web browser without requiring software installation.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

USER ACCOUNTS AND REGISTRATION

3.1 Account Creation: To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited activities.

ACCEPTABLE USE AND PROHIBITED ACTIVITIES

You agree to use the Service in good faith and solely for its intended purpose. The following activities are strictly prohibited:

Using automated systems (bots, scrapers, spiders) to access or interact with the Service
Processing files at a rate that exceeds what a human can reasonably accomplish manually
Sharing account credentials or allowing third parties to access your account
Uploading content that is illegal, harmful, infringing, or violates third-party rights
Uploading malware, viruses, or any malicious code
Attempting to circumvent security features or interfere with Service operation
Using the Service to generate, create, or disseminate synthetic media or deepfakes intended to deceive
Reselling, redistributing, or commercially exploiting the Service without authorization
Engaging in activities that violate applicable laws, including data protection regulations

We reserve the right to investigate accounts showing unusual activity patterns and to suspend or terminate accounts found in violation of these Terms.

FILE PROCESSING, STORAGE, AND SECURITY

5.1 Temporary Processing: Files uploaded to FynePDF are processed temporarily to provide the requested service. We do not access, analyze, or review the content of your files unless explicitly requested for technical support purposes.

5.2 Automatic Deletion: All uploaded files are automatically and permanently deleted from our servers 15 minutes after processing is complete. Files are only retained for the minimum time necessary to complete the requested operation and allow for download.

5.3 Security Measures:

All file transfers use SSL/TLS encryption (HTTPS)
Files are stored using AES-256 encryption on AWS S3 secure servers
Our infrastructure is protected by Cloudflare security services
We implement industry-standard security protocols to prevent unauthorized access

5.4 No Permanent Storage: We do not maintain permanent copies of your files unless you explicitly use cloud storage features i.e. the library. You are solely responsible for downloading and preserving your processed files before the deletion period expires.

5.5 Third-Party Infrastructure: We utilize Amazon Web Services (AWS) S3 for file storage and Cloudflare for domain hosting and security. By using our Service, you acknowledge that your files will be processed through these secure, industry-standard platforms.

INTELLECTUAL PROPERTY RIGHTS

6.1 Your Content: You retain all ownership rights to the files and content you upload to the Service. You grant FynePDF a limited, temporary license to process your files solely for the purpose of providing the requested service.

6.2 Our Intellectual Property: All software, designs, text, graphics, logos, and other content provided by FynePDF remain our exclusive property. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6.3 Copyright Infringement: You may not upload or process files that infringe on third-party intellectual property rights. If you believe material on our Service infringes your copyright, contact us at[email protected] with detailed information about the alleged infringement.

PRIVACY AND DATA PROTECTION

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using FynePDF, you consent to the collection and use of information as detailed in the Privacy Policy.

We comply with applicable data protection regulations including GDPR and CCPA principles. We process personal data lawfully, fairly, and transparently, maintaining data only for as long as necessary to provide our services.

PAYMENTS, BILLING, AND SUBSCRIPTIONS

8.1 Payment Processing: All payments are processed securely throughhttps://paddle.com, our authorized payment processor and Merchant of Record. Paddle handles all payment transactions, tax collection, invoicing, subscription management, and compliance.

8.2 Pricing: Current pricing for all plans is available athttps://fynepdf.com/pricing . We reserve the right to modify pricing, but changes will not affect active subscriptions until renewal.

8.3 Subscription Terms:

Subscriptions automatically renew unless cancelled before the renewal date
You may cancel your subscription at any time through your account settings or by contacting Paddle support
Cancellation stops future billing; you retain access until the current billing period ends

8.4 Payment Information: You agree to provide current, complete, and accurate billing information. All payment information is securely processed by Paddle; FynePDF does not store your full credit card details.

8.5 Failed Payments: If payment fails, we may suspend your account until payment is successfully processed. Paddle will handle payment retries and notifications.

REFUND POLICY

9.1 Money-Back Guarantee: FynePDF offers a 14-day money-back guarantee for all subscription purchases. If you are not satisfied with our Service, you may request a full refund within 14 days of your initial purchase.

9.2 How to Request a Refund: To request a refund, contact Paddle customer support directly throughpaddle.net or email[email protected] . Refunds are typically processed within 5-10 business days to the original payment method.

9.3 Refund Exceptions: Refunds are not available for:

Subscription renewals (after the initial 30-day period)
Usage-based charges or overage fees
Violations of these Terms resulting in account termination
Purchases made more than 14 days ago

9.4 Chargebacks: Initiating a chargeback without first requesting a refund through proper channels violates these Terms and may result in immediate account termination and suspension of services.

SERVICE AVAILABILITY AND LIMITATIONS

10.1 No Warranty: The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

10.2 Service Interruptions: We may perform maintenance, updates, or experience technical issues that result in temporary service interruptions. We will make reasonable efforts to notify users of scheduled maintenance.

10.3 Limitation of Liability: To the maximum extent permitted by law, FynePDF shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

10.4 Maximum Liability: Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or 100 USD, whichever is greater.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FynePDF, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Any content you upload or process through the Service

GOVERNING LAW AND DISPUTE RESOLUTION

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law principles.

12.2 Dispute Resolution: Any disputes arising from these Terms or the Service shall first be addressed through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Nepal in accordance with local arbitration rules.

12.3 Class Action Waiver: You agree that any proceedings will be conducted only on an individual basis and not as a class action or representative proceeding.

TERMINATION

13.1 By You: You may terminate your account at any time by discontinuing use of the Service or deleting your account or you can cancel your plan by going to the plan tab in account setting.

13.2 By Us: We may suspend or terminate your access to the Service immediately, without prior notice, for any violation of these Terms or for any other reason at our sole discretion.

13.3 Effect of Termination: Upon termination, all licenses granted to you will cease, and you must immediately cease all use of the Service. Provisions regarding intellectual property, indemnification, limitation of liability, and governing law shall survive termination.

THIRD-PARTY SERVICES AND LINKS

The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, and any other legal notices published on the Service, constitute the entire agreement between you and FynePDF regarding the Service.
